AMENDED SUPPLEMENTAL MONITION
Notice is given that the Limitation Plaintiff, Kimeth Gardner (hereinafter, the “Limitation Plaintiff”), as the owner of a 2022 Sylvan 25 L Series tritoon vessel (Hull Identification Number: SYL80106F122, State Registration Number: FL3149TB; hereinafter, the “Limitation Vessel”), has filed a Complaint in Admiralty pursuant to 46 U.S.C. § 30501 et. seq., claiming the right of exoneration from or limitation of liability from any and all claims arising from the Limitation Vessel being blown from its moorings by the forces of wind and wave caused by Hurricane Milton and coming to rest ashore on a neighboring property or about October 9, 2024 (hereinafter, the “Stranding”).
All persons having claims against Limitation Plaintiff KIMETH GARDNER and/or the Limitation Vessel in relation to the Stranding must file their claims as provided in Rule F of the Federal Rules of Civil Procedure, Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions (hereinafter, the “Supplemental Admiralty Rules”), with the Clerk of this Court, the United States District Court for the Middle District of Florida, and serve on or mail to the Limitation Plaintiff’s counsel: Christopher A. Abel, Esquire, Willcox & Savage, P.C., 440 Monticello Avenue, Suite 2200, Norfolk, Virginia 23510 and Eric Theil, Esquire, Banker Lopez Gassler P.A., 501 E. Kennedy Blvd., Suite 1700, Tampa, Florida 33602 a copy thereof on or before the 17th day of October 2025, or suffer default. Personal attendance is not required.
Any claimant desiring to contest the Limitation Plaintiff’s allegations must file an answer to the Limitation Complaint as required by Supplemental Admiralty Rule F(5) and must serve on or mail to counsel for the Limitation Plaintiff a copy thereof, unless claimant’s claim, as set forth hereinabove, has included an answer.
