THE SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT
Notice is given that the Southwest Florida Water Management District’s September 30, 2025, Final Agency Action is approval of Application 926616 for an Environmental Resource Permit minor modification to Management and Storage of Surface Water (MSSW) No. 49002364.005 for the withdrawal of 0.81 credit units from the Compensation Banking System established in MSSW No. 49002364.005, entitled Trinity Communities East Pasco Tract. With this modification, the Compensation Banking System remaining credit unit balance is 0.00. The Compensation Banking System applies to lands located in Hillsborough, Pasco and Pinellas Counties, Sec/Twp/Rge: S29/T26S/R17E, S31/T26S/R17E, S04/T27S/R16E, S02/T27S/R16E, S30/T26S/R17E, S35/T26S/R16E, S36/T26S/R16E, S27/T26S/R17E, S34/T26S/R17E, S32/T26S/R17E, S03/T27S/R16E, S25/T26S/R16E, S01/T27S/R16E, S33/T26S/R17E, S28/T26S/R17E. The Permit applicant is Trinity Communities Master Association, Inc., whose address is 3527 Palm Harbor Blvd., Palm Harbor, FL 34683. The Permit No. is 43002364.228.
The file(s) pertaining to the project referred to above is available for inspection Monday through Friday, except for legal holidays, 8:00 a.m. to 5:00 p.m., at the Southwest Florida Water Management District’s Tampa Service Office, 7601 U.S. Highway 301 North, Tampa, Florida 33637.
The District’s agency action is final unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57 of the Florida Statutes before the deadline for filing a petition.
A person whose substantial interests are or may be affected by the District’s action has the right to request an administrative hearing on that action pursuant to Sections 120.569 and 120.57, Florida Statutes, and Chapter 28-106, Florida Administrative Code, of the Uniform Rules of Procedure. Persons seeking a hearing on a District decision which affects or may affect their substantial interests shall file a petition for hearing with the Agency Clerk of the District at the District’s Tampa address, 7601 US Highway 301, Tampa, FL 33637-6759, within 21 days of receipt of written notice of the decision, unless one of the following shorter time periods apply: (1) within 14 days of the notice of consolidated intent to grant or deny concurrently reviewed applications for environmental resource permits and use of sovereign submerged lands pursuant to Section 373.427, Florida Statutes; or (2) within 14 days of service of an Administrative Order pursuant to Section 373.119(1), Florida Statutes.
Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the District’s final agency action may be different from the position taken by it in this notice of agency action. Persons whose substantial interests will be affected by any such final decision of the District in this matter have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.
Mediation pursuant to Section 120.573, F.S., to settle an administrative dispute regarding the District’s action in this matter is not available prior to the filing of a request for hearing.
