NOTICE OF INTENT TO CONSIDER AMENDMENT TO
REPEAL AND REPLACE THE HILLSBOROUGH COUNTY
SOLICITATION AND DISTRIBUTION IN PUBLIC ROADS ORDINANCE
NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN:
The Board of County Commissioners of Hillsborough County, Florida, intends to consider, for the purpose of enactment, the following ordinance at a public hearing on Wednesday, March 4, 2026, at 10:00 a.m. in the 2nd floor Board Room at County Center, 601 E. Kennedy Boulevard in Tampa, Florida 33602:
AN ORDINANCE AMENDING CHAPTER 42, ARTICLE II, HILLSBOROUGH COUNTY CODE OF ORDINANCES, PART “A”, REPEALING THE SOLICITATION AND DISTRIBUTION IN PUBLIC ROADS ORDINANCE AND REPLACING IT WITH THE SOLICITATION AND DISTRIBUTION IN PUBLIC ROADWAYS ORDINANCE; PROVIDING TITLE AND INTENT, DEFINITIONS, FINDINGS AND DETERMINATIONS; PROHIBITING PERSONS FROM GOING UPON THE TRAVELED PORTION OF THE ROADWAY, OR BEING WITHIN FOUR FEET OF THE TRAVELED PORTION OF THE ROADWAY, FOR THE PURPOSE OF DISTRIBUTING, RECEIVING, GIVING, OR EXCHANGING ITEMS OR THINGS TO OR FROM MOTOR VEHICLE OCCUPANTS; PROVIDING FOR TERRITORY EMBRACED; PROVIDING FOR SEVERABILITY; PROVIDING FOR PENALTIES; PROVIDING AN EFFECTIVE DATE.

Anyone wishing to speak at the public hearing may do so: (1) by personally appearing in the Board Room for the public hearing; or (2) by opting to participate virtually via communications media technology.
Anyone opting to participate virtually must first complete an online Public Comment Signup Form. To complete the online Public Comment Signup Form, please go to hcfl.gov/government/meeting-information/sign-up-to-speak-at-a-meeting, click on “Sign Up to Speak at a BOCC Meeting,” and then follow the directions. You will be required to provide your name and telephone number on the online form. This information is requested to facilitate the audio-conferencing process. The Chair will call on speakers by name in the order in which they have completed the online Public Comment Signup Form. Prioritization is on a first-come, first-served basis. An audio call-in number will be provided to participants who have completed the form after it is received by the County. All callers will be muted upon calling and will be unmuted in the submission order after being recognized by the Chair by name. Up to three (3) minutes are allowed for each speaker. Signups for the March 4th public hearing will not be accepted after 9:00 a.m. on the day of the hearing. Public comments offered using communications media technology will be afforded equal consideration as if the public comments were offered in person.
The public can listen and view the public hearing live in the following ways:
• The County’s official YouTube channel: YouTube.com/HillsboroughCountyMeetings.
• The County’s HTV channels on cable television: Spectrum 637 and Frontier 22.
• The HCFLGov.net website by going to https://hcfl.gov/government/meeting-information/hillsborough-television and selecting the “Live Meeting” button.
• Listening to the meeting on smart phones by going to the above YouTube link.

All interested parties are invited to appear and be heard with respect to the proposed ordinance. Copies of the proposed ordinance may be obtained by contacting the Hillsborough County Attorney’s Office at (813) 307-3143 or by email at clarkc@hcfl.gov. Alternatively, a copy of the proposed Ordinance may be inspected by the public at the Clerk’s Office on the 12th floor of County Center at 601 East Kennedy Blvd., Tampa, Florida 33602.

Anyone who might wish to appeal any decision made by the Hillsborough County Board of County Commissioners regarding any matter considered at the forthcoming public hearing or Meeting is hereby advised that they will need a record of the proceedings, and for such purpose they may need to ensure that a verbatim record of the proceedings is made which will include the testimony and evidence upon which such appeal is to be based.
