NOTICE OF PROPOSED AGENCY ACTION

The Hillsborough County Environmental Protection Commission (“EPC”) gives notice that it proposes to approve use of an Institutional Control and Engineering Control in the form of a Recorded Declaration of Restrictive Covenant (“DRC”). GS South Tampa II Owner, LLC (“GS South Tampa II”) is seeking the DRC in reference to Florida Department of Environmental Protection (“FDEP”) Site ID ERIC_17841, BF No. BF292101001, and EPC/DA No. OLC-030521 and Parcel Folio ID No. 137041-0000, on the ELAN Interbay Property located at 7210 Interbay Blvd., Tampa, Florida 33616.

The DRC intends to restrict exposure to soil and/or groundwater impacts on the ELAN Interbay Property through a series of institutional and engineering controls.

Complete copies of the Declaration and the EPC’s evaluation are available online at http://depedms.dep.state.fl.us/Oculus/servlet/login. Please use the FDEP Site ID ERIC_17841 or BF No. BF292101001 to communicate with the EPC, FDEP, or the online document management system (OCULUS).

Local governments with jurisdiction over the property subject to the Institutional Control; real property owner(s) of any property subject to the Institutional or Engineering Control, residents of any property subject to the Institutional Control; and any party holding a materially affected encumbrance in the area subject to the Controls have 30 days from publication of this Notice to provide comments to the EPC.
