MOTION FOR CONSTRUCTIVE SERVICE
COMES NOW, the Petitioner, NICOLE ANN THIBAULT, pursuant to Chapter 49, Florida Statutes, and Florida Family Law Rule of Procedure 12.070, and respectfully moves this Court for an Order authorizing constructive service of process by publication upon the Respondent, DAVID SCOTT THIBAULT, and as grounds therefore states:
Before this court is an action for Domestication and Enforcement of a Foreign Order.
The Respondent, DAVID SCOTT THIBAULT, is over the age of eighteen (18) years of age.
Petitioner has attempted to serve Respondent with process at his last known residence: .
Petitioner has attempted to serve Respondent at his last known place of employment:
Petitioner had the process server, ABC Legal, Inc., conduct a skip-trace investigation.
Petitioner has attempted to serve Respondent at his last listed address online:
The process server from the company ABC Legal, Inc., attempted to serve the Respondent at the above-listed addresses but were either met with no answer, denied entry into the workplace, and relayed to them that service was not allowed on property per the employer’s policy.
The Petitioner has no information as to the Respondent’s current whereabouts, other than his residence in the general vicinity of Pasco County, Florida.
Attached hereto as Exhibit A is the process server’s affidavits of non-service, showing proof of these unsuccessful attempts.
Based on the process server’s reports and Petitioner’s knowledge, Respondent does reside is actively evading personal service. The process server’s address findings are attached hereto as Exhibit B.
Petitioner has made diligent inquiry into the whereabouts of Respondent, including but not limited to attempting personal service multiple times having a skip-trace investigation conducted, and reviewing available public records. An Affidavit of Diligent Service will be filed in conjunction with this Motion.
Despite these diligent efforts, Respondent cannot be personally served because he is actively avoiding or concealing herself to evade service.
Under Chapter 49, Florida Statutes, when personal service cannot be affected after diligent search and inquiry, constructive service by publication is authorized.
WHEREFORE, Petitioner, NICOLE ANN THIBAULT, respectfully requests that this Court enter an Order authorizing constructive service of process upon the Respondent by publication in accordance with Chapter 49, Florida Statutes, and for such other relief as this Court deems just and proper.
I understand that I am swearing or affirming under oath to the truthfulness of the claims made in this MOTION and that the punishment for knowingly making a false statement includes fines and/or imprisonment.
