NOTICE OF ERP ISSUANCE

The Department of Environmental Protection gives notice of its final agency action for Environmental Resource Permit Modification (File No. MMR_453519-002-EI) to Mosaic Fertilizer, LLC., for the issuance of an Environmental Resource Permit for borrow pits with a project name of “Mosaic Hillsborough County Land Alteration”. The project comprises a total of 14.4 acres of three closely-spaced borrow pits on an 18.6-acre property in Section 6, Township 27 South, Range 22 East, in Hillsborough County. The estimated life of mine, including reclamation, will be 10 years from permit issuance date. The material to be excavated is previously cleared and graded land. There are no impacts on wetlands or other surface waters (OSWs) and no impervious surface. Following reclamation, the property will consist of 14.4 acres of Lakes (FLUCCS 520), 3.4 acres of access drive (FLUCCS 810), and 0.8 acres of avoided wetlands and other surface waters.

The project is in the Hillsborough River Basin watershed, Class III waters. A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S. Pursuant to Rules 28- 106.201 and 28-106.301, F.A.C., the petition must be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us. Also, a copy of the petition shall be mailed to the applicant at the time of filing. The petition must be filed within 21 days of this notice.
