NOTICE OF PETITION FOR
EXONERATION OR LIMITATION OF LIABILITY
NOTICE IS HEREBY GIVEN that JOHN TIMMEL and MARGUERITE TIMMEL, as owners of the 48’ Duffy Trawler, M/Y IRISH AYES (hereinafter the “Vessel”), have filed a Petition in the United States District Court for the Middle District of Florida, Tampa Division, pursuant to 46 U.S.C. §§ 30501–30512 and Rule F of the Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions, seeking exoneration from or limitation of liability for any and all claims for damages, loss, injury, or death arising out of a March 13, 2026 vessel fire, as more fully set forth in the Petition.
All persons asserting claims with respect to the foregoing incident must file their respective claims with the Clerk of the United States District Court for the Middle District of Florida, Tampa Division, and serve a copy thereof on counsel for Petitioners, Richard D. Rusak, Esq., Cole, Scott & Kissane, P.A., 9150 South Dadeland Boulevard, Suite 1400, Miami, Florida 33156, on or before the 7th Day of August, 2026, or an alternative date to be set by the Court, or be defaulted.
All persons desiring to contest either the right to exoneration from or the right to limitation of liability must also file and serve an answer to the Petition on or before the aforementioned date, unless their claim includes such an answer, or be defaulted.
